Terms of Service

Effective March 30, 2026

These Terms of Service ("Terms") govern your access to and use of the glimpsegen platform, including our website, API, and generated outputs (collectively, the "Service"), operated by Highland Technical, LLC, an Ohio limited liability company doing business as Prizmatik (prizmatik.io) ("we", "us", or "Highland Technical").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering a legally binding contract to use the Service. By registering you represent that this is the case.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@glimpse-gen.com if you believe your account has been compromised.

3. Plans, Credits, and Billing

The Service is offered under the following plans:

1 credit = 1 generation or fix pass. 4 credits = a scene composition. Credits reset at the start of each billing cycle and do not carry over.

Paid subscriptions are billed monthly in advance via Stripe. You may cancel at any time; your subscription remains active until the end of the current billing period. We do not issue pro-rated refunds for partial periods.

Pricing changes. We reserve the right to change the price or credit allocations of any plan at any time. For active paid subscribers, price changes take effect at the start of the next billing cycle following the change; your current rate is locked until then. We will provide at least 30 days' notice of any price increase via email to the address on your account and by posting a notice on the Service. Notice is considered delivered when the email is sent to the address on file, regardless of whether it is received or read. If you do not cancel before the new price takes effect, your continued use of the Service constitutes acceptance of the new pricing.

4. Free Plan: Model Retention for Development

The Service includes an automated quality pipeline that may run after generation. This pipeline analyses the generated model's geometry, detects structural issues such as gaps or misaligned components, and may submit the model code to an AI system for an automated fix pass. The pipeline runs without user intervention and is part of normal Service operation.

If you are on the Free plan, you grant Highland Technical, LLC a non-exclusive, royalty-free, worldwide licence to retain, analyse, and use your generated 3D models, associated prompts, and quality pass data for internal product development and quality improvement purposes, including but not limited to training and evaluating AI systems.

Quality pass data means the 3D model code submitted for a fix pass and the corrected code output produced when a quality/fix pass is triggered through the Service. This data may be retained in addition to the initial generation outputs and prompts described above.

This licence does not apply to users on any paid plan. Paid plan users retain full ownership of their generated outputs subject to §5 below.

5. Intellectual Property and Output Ownership

Paid plan users (Builder, Pro, Team). To the extent Highland Technical holds any rights in the 3D models and code outputs you generate through the Service, Highland Technical hereby assigns to you all such rights worldwide in perpetuity, royalty-free, with no further action required. You may use, reproduce, modify, distribute, sell, and sublicense your outputs for any purpose, including commercial client work, products, and revenue-generating projects, subject to these Terms.

Free plan users. You are granted a limited, personal, non-exclusive, non-transferable licence to use your generated outputs for personal and limited small-scale purposes, subject to the following conditions: (a) you may share outputs on social media and in personal portfolios with attribution to glimpsegen where practical; (b) you may sell physical objects manufactured from a Free-plan STL output, provided the total number of units sold from any single output does not exceed 10 units across all channels and formats; (c) you may not sublicense, relicense, or transfer the output files themselves to any third party for value; (d) you may not incorporate Free-plan outputs into any commercial software product, SaaS offering, client deliverable produced for hire, or any project where the output file (rather than a physical object derived from it) is itself the thing of value. Sales exceeding the 10-unit limit require an upgrade to a paid plan.

Community feed. If you choose to share a generated output to the glimpsegen community feed, you grant Highland Technical a limited, non-exclusive, royalty-free licence to display the output thumbnail and associated prompt on the Service solely for the purpose of operating the community feed feature. This display licence does not expand beyond that purpose and terminates automatically when you unshare the output or delete your account. Nothing in this paragraph limits Highland Technical's rights under §4 with respect to Free plan outputs.

Pipeline processing. By using the Service, you agree that Highland Technical may process all intermediate outputs produced during generation and the quality pipeline, including initial AI-generated code, intermediate code revisions, geometry analysis data, and fix-pass inputs and outputs, solely to produce and deliver the final output to your account. This authorisation terminates upon delivery or upon a permanent generation failure, whichever occurs first. It does not affect the rights applicable to your delivered output under this §5 or §4. Highland Technical's right to use fix-pass data for internal product development and quality improvement purposes is governed solely by §4.

Licence at time of delivery. "Delivery" occurs when the completed output is made available for download or display in your account dashboard. The licence applicable to any output is determined by the plan active on your account at the moment of delivery. Upgrading to a paid plan unlocks the paid-plan licence for all outputs delivered while the paid plan is active; it does not retroactively change the licence terms for outputs delivered under a Free plan prior to the upgrade.

No IP warranty. Because outputs are generated by AI, Highland Technical makes no representation that any output is free of third-party intellectual property claims. You are solely responsible for evaluating and clearing any IP, copyright, or design-patent risks before using outputs commercially. Highland Technical's indemnification obligations do not extend to third-party IP claims arising from your use of generated outputs.

You represent that any prompts you submit do not infringe the intellectual property rights of any third party. All trademarks, software, and infrastructure of the Service remain the exclusive property of Highland Technical, LLC.

We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as is". We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

8. Termination

Termination by Highland Technical. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Company-initiated termination takes effect immediately. Upon confirmation of termination, your user data will be immediately and irrevocably destroyed.

Termination by you. You may delete your account at any time from the Settings page. If you are on a Free plan, termination takes effect immediately. If you are on a paid plan, your account and access to the Service will remain active until the end of your current billing period, after which your account will be permanently closed and your data destroyed. No pro-rated refund is issued for the remainder of a billing period following voluntary deletion.

Effect on output licences. Upon termination by either party, your right to access and use the Service ceases at the applicable effective date; however, the licences and rights granted in §5 with respect to outputs already generated prior to termination survive for both paid and Free plan users.

Re-registration. Following voluntary account deletion or standard termination, you are welcome to create a new account at any time. However, if your account was terminated due to misuse that resulted in an infrastructure-level ban (including but not limited to abuse, automated scraping, deliberate circumvention of rate limits, or activity that posed a security or operational risk to the Service), re-registration is prohibited without express written permission from Highland Technical.

The following information is not subject to deletion upon account termination, whether initiated by you or by Highland Technical, and will be retained for the periods stated: (a) 3D models, associated prompts, and quality pass data generated under a Free plan, retained pursuant to §4, for which the licence in §4 survives termination; (b) support ticket records and related correspondence, retained for up to 3 years for dispute resolution and service quality purposes; and (c) billing records, transaction history, and other financial information, retained for up to 7 years as required by applicable law and standard accounting practices.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that outputs will be accurate, complete, or suitable for any specific use.

10. Limitation of Liability

To the maximum extent permitted by law, Highland Technical, LLC's total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) $50 USD. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless Highland Technical, LLC and its officers, employees, and agents from any claims, damages, losses, and expenses arising from your use of the Service or breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Ohio.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Changes to pricing or credit allocations are governed by the specific notice provisions in §3, which take precedence over the general 14-day notice period in cases of conflict.

14. General Provisions

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

Entire agreement. These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Highland Technical concerning the Service and supersede all prior and contemporaneous communications, representations, and agreements, whether oral or written.

No waiver. Highland Technical's failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion.

Informal resolution. Before initiating any legal proceeding, you agree to contact us at legal@glimpse-gen.com and provide a written description of the dispute. Both parties agree to make a good-faith effort to resolve the matter informally within 30 days of receipt of that notice before resorting to formal legal action.

Force majeure. Highland Technical is not liable for any failure or delay in performance of the Service resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet or infrastructure outages, cyberattacks, or the unavailability, degradation, or change in terms of third-party AI providers (including xAI and Google) on whose APIs the Service depends. We will make reasonable efforts to restore Service availability and notify affected users promptly.

Third-party AI dependencies. The Service generates content using third-party large language model APIs whose availability, pricing, and output policies are outside Highland Technical's control. We reserve the right to switch providers, adjust credit costs, or modify generation capabilities in response to upstream changes, with notice where practicable.

Age misrepresentation. If you provided false information to circumvent the 18-year-old eligibility requirement in §1, Highland Technical reserves the right to immediately terminate your account, void any licences granted under §5, and retain any amounts paid.
